Section 01 — General Disclaimer

All information contained on the Day Strike Trading website is compiled for the convenience and use of the site's visitors and subscribers. It is provided without responsibility for its accuracy. Any site visitor or subscriber having access to information contained within this website is under the strict condition that any errors or omissions shall not provide the basis of any claim, demand, or cause of action against Day Strike Trading or anyone affiliated therewith.

Section 02 — Trade Signals

Performance relied upon by Day Strike Trading is intended solely for educational and demonstration purposes only. Certain aspects of Day Strike Trading results are based upon hypothetical trading performance information, performed on a simulated account without any consideration for commissions or slippage. With respect to such performance, please note the following:

Hypothetical or simulated performance results have certain inherent limitations, unlike an actual performance record. Simulated results do not represent actual trading. Since the trades have not actually been executed, results may have under- or over-compensated for the impact, if any, of market factors, such as liquidity. Simulated programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will achieve profits or losses like those shown.

Trading signal services on futures, stocks, forex, and options contracts are speculative, and no guarantee is given that past, present, or future signals will provide profits to traders. Speculative by nature may mean that the signals will indeed cause the trader to incur losses. All trade signals provided to visitors and subscribers are purely for educational and demonstration purposes only, and any participation in the futures, stocks, forex, and options markets utilizing the Day Strike Trading service is entirely at your own risk.

Day Strike Trading is not a financial advisory service. We do not provide investment advice in any capacity, and visitors or subscribers assume full liability for all trading decisions. We provide education and training, and Day Strike Trading, its employees, and associates take no responsibility for any profits incurred or losses. Neither does Day Strike Trading have any financial interest in the outcome of any trades other than within the terms of agreement for subscription services.

Section 03 — Information

Any report or documentation presented on this website includes information from sources believed to be reliable and accurate as of the date of publication. No independent verification has been made, nor do we guarantee its accuracy or completeness. Opinions expressed are subject to change without notice. Any reliance on information contained in these reports is at the sole risk of the site visitor or subscriber. Any reproduction or retransmission of this report without express written consent of Day Strike Trading is strictly prohibited.

Section 04 — Live Trading & Training Room

All signals and trading opportunities disclosed to visitors or subscribers within the Live Trading Room are for educational and demonstration purposes only. Live trading demonstrations are presented on simulated trading accounts without consideration for commissions or slippage. Day Strike Trading takes no responsibility for any participation by visitors or subscribers in the markets, nor for any profits or losses incurred.

Section 05 — Participation

Trading in forex, futures, stocks, and options involves substantial risk and may not be suitable for everyone. Never risk more than 2% of your account on any trade. Do your own diligence and consult a financial adviser prior to making any trading decisions. Day Strike Trading is not a registered financial adviser or licensed Commodity Trading Adviser.

Section 06 — Subscription Agreement

Subscribers to the Day Strike Trading website agree to pay a monthly fee in accordance with the Terms of Use. No registered subscriber may copy, sell, reproduce, transmit, or publicly display any information or materials related to Day Strike Trading.

Subscriptions are solely for the fee payer and may not be transferred or shared. The subscriber will be liable for any third-party access facilitated by the subscriber.

Section 07 — Purchases & Refunds

Day Strike Trading offers digital products and fee-based memberships. All sales are final. No refunds or credits are offered for any reason, including failure to cancel prior to renewal.

By purchasing subscription services, you authorize recurring billing until cancellation according to these Terms. Failure of payment will result in termination of access.

Section 08 — Cancellations

You may cancel at any time by emailing info@daystriketrading.com.

Cancellation requests must receive confirmation. Telephone or other forms of communication will not be accepted. Upon cancellation, access will be removed and content forfeited. No data can be recovered after cancellation.

Section 09 — Educational Services & Refunds

Purchase of educational services or subscriptions grants access to proprietary content. No refunds will be granted once access is provided, in whole or in part.

Section 10 — Termination

Day Strike Trading reserves the right to terminate subscriptions for violation of these Terms or disruptive behavior. No refund will be issued.

Section 11 — Risk Disclosures

Risk Disclaimer

Trading involves significant risk. You may lose more than your initial investment. Do not trade with money you cannot afford to lose. No representation is being made regarding future performance.

Risk Disclosure

Futures and forex trading contain substantial risk and are not for every investor. An investor could potentially lose all or more than the initial investment. Risk capital is money that can be lost without jeopardizing one's financial security or lifestyle. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. Past performance is not necessarily indicative of future results.

Hypothetical Performance Disclosure

Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown; in fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk of actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect trading results.

Section 12 — No Investment, Legal, or Tax Advice

Day Strike Trading provides educational content, software tools, and membership access only. We are not a registered investment adviser, broker-dealer, commodity trading adviser, financial planner, or tax adviser. Nothing on this website or in any live room, email, or download constitutes a recommendation or solicitation to buy or sell any security, futures contract, option, or other instrument.

You are solely responsible for your trading decisions and for consulting licensed professionals regarding your financial situation, tax obligations, and compliance with applicable laws.

Section 13 — Intellectual Property & Software License

All website content, indicators, templates, videos, written materials, logos, and member hub materials are owned by Day Strike Trading or its licensors and are protected by copyright and other intellectual property laws.

Your membership grants a limited, personal, non-exclusive, non-transferable, revocable license to access materials for your own trading education while your subscription is active. You may not copy, redistribute, resell, sublicense, reverse engineer, or share login credentials or license keys. NinjaTrader® and other third-party platform names are trademarks of their respective owners; Day Strike Trading is not affiliated with or endorsed by NinjaTrader unless expressly stated.

Futures membership may include activation of proprietary indicators on a limited number of machine IDs as described at checkout or in your member hub. Circumventing license or machine-ID limits is grounds for immediate termination without refund.

Section 14 — Third-Party Platforms & Services

We use third parties to operate the business, including payment processing (Authorize.Net), hosting (Vercel), database and authentication (Supabase), and live session delivery (Zoom). Your use of those services may be subject to their separate terms and privacy policies.

Live sessions are delivered through third-party meeting tools (for example Zoom). We do not control outages, recording features, or policy changes on third-party platforms. Live room access is tied to your active membership status.

Section 15 — Member Conduct

You agree not to harass staff or members, post unlawful content, share others’ personal data without consent, distribute malware, scrape the site, attempt unauthorized access, or use the service for any unlawful purpose. We may remove community access, terminate accounts, and pursue legal remedies for violations.

Section 16 — Limitation of Liability

To the fullest extent permitted by law, Day Strike Trading and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, trading losses, or business interruption, arising from your use of the site or services, even if we have been advised of the possibility of such damages.

Our total liability for any claim relating to the services shall not exceed the greater of (a) the amount you paid to Day Strike Trading in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

Section 17 — Indemnification

You agree to defend, indemnify, and hold harmless Day Strike Trading and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the services, your trading activity, your violation of these Terms, or your violation of any third-party rights.

Section 18 — Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. You agree that exclusive jurisdiction for disputes arising from these Terms or the services shall lie in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

Before filing suit, you agree to contact us at info@daystriketrading.com and attempt in good faith to resolve the dispute for at least thirty (30) days.

To the extent permitted by law, you agree that disputes will be resolved only on an individual basis and not as a class, consolidated, or representative action.

Section 19 — Electronic Consent

You consent to receive communications electronically (email, website notices, and account messages). You agree that electronic acceptance, click-through acceptance, and continued use of the site constitute your signature and agreement to these Terms and related policies.

Section 20 — Prohibited Uses

You may not use the services to violate securities or commodities laws, manipulate markets, misrepresent affiliation with Day Strike Trading, operate account-sharing or signal-reselling schemes, or interfere with site security. We may cooperate with law enforcement regarding illegal activity.

Section 21 — Live Room & Complimentary Access

Live room access may be included with certain products for a defined period (for example, a number of months with lifetime Futures or bundle plans) or sold as a standalone monthly membership. Access periods, renewal rules, and included features are described at checkout and may change with notice.

Complimentary or trial access (including email-based trials) may be modified or discontinued at any time. Trial access does not convert to paid access unless you complete checkout.

Section 22 — Chargebacks & Payment Disputes

Filing a chargeback or payment dispute without first contacting support may result in immediate suspension of access. We reserve the right to provide payment records to processors and to terminate accounts for abusive or fraudulent disputes.

Section 23 — Changes to Terms

We may update these Terms at any time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance. If you do not agree, cancel before your next renewal and stop using the services.

Section 24 — Severability & Entire Agreement

If any provision is held unenforceable, the remaining provisions remain in effect. These Terms, together with the policies linked above and product-specific terms at checkout, constitute the entire agreement between you and Day Strike Trading regarding the services.
